Nature of conduct to be inquired into:

1.  Between February 17, 2021 and April 9, 2021, in relation to a family law matter, you acted in a conflict of interest when you represented your client, RB against DB, whom you had previously represented in the same family law matter, contrary to one or more of rules 2.1-3(b), 3.4-1, 3.4-2, and 3.4-10 of the Code of Professional Conduct for British Columbia. 

This conduct constitutes professional misconduct, pursuant to s. 38(4) of the Legal Profession Act. 

2.  On or about October 8 and 9, 2020, you caused your staff to communicate and meet with your former client, DB, to have him sign documents, in the absence of his counsel, and without the knowledge or consent of his counsel, when you knew or ought to have known that DB was represented by counsel, contrary to one or both of rules 2.1-4(b) and 7.2-6 of the Code of Professional Conduct for British Columbia. 

This conduct constitutes professional misconduct, pursuant to s. 38(4) of the Legal Profession Act. 

3.  On or about October 9, 2020, you failed to discharge your responsibilities honourably and with integrity when you represented on a release letter that you had witnessed the signature of your former client, DB, when you knew or ought to have known, that this was not true, contrary to rule 2.2-1 of the Code of Professional Conduct for British Columbia

This conduct constitutes professional misconduct, pursuant to s. 38(4) of the Legal Profession Act. 

4.  On or about October 9, 2020, when you prepared or caused to be prepared, a release letter for execution by your former client, DB, you included statements in the release letter, that DB did not discuss any matter related to property, finances or employment with you, and that DB never disclosed or provided confidential documents to you, which statements you knew or ought to have known were misleading or untrue, contrary to rule 2.2-1 of the Code of Professional Conduct for British Columbia. 

This conduct constitutes professional misconduct pursuant to s. 38(4) of the Legal Profession Act. 

5.  On or about March 19, 2021, in relation to a family law matter, you filed, or caused to be filed the affidavit of KK, dated March 19, 2021, which contained confidential information of your former client DB, contrary to one or both of rules 3.3-1 and 3.3-2 of the Code of Professional Conduct for British Columbia. 

This conduct constitutes professional misconduct, pursuant to s. 38(4) of the Legal Profession Act.
